Attorney General Michelle Henry has announced a settlement concerning Split Rock Resort in Lake Harmony, addressing complaints of mistreatment against timeshare owners. This legal action and subsequent settlement aim to provide restitution for consumers who experienced unfair practices at the popular Poconos resort.
The lawsuit, initiated by the Attorney General’s Office, alleged that Split Rock engaged in practices violating Pennsylvania’s Unfair Trade Practices and Consumer Protection Laws. Timeshare owners reportedly faced issues such as denied property access, excessive maintenance fees, and unlawful usage fees. These allegations painted a picture of consumers paying for vacation accommodations at Split Rock Resort Poconos but not receiving the services and access they were entitled to.
According to Attorney General Henry, the settlement seeks to rectify these issues, stating, “Consumers who paid hard-earned dollars for vacation accommodations for themselves and their families were overcharged and denied access to their getaway resort.” The core of the settlement is the establishment of a restitution fund, potentially reaching $250,000, to compensate eligible timeshare owners affected by these practices at Split Rock Resort Poconos.
Under the terms of the settlement, Split Rock Investments, LLC, and SCH USA, LLC, operating as “Bel Air Owner’s Circle,” are obligated to adhere to all applicable laws. In addition to the restitution fund, the agreement includes $5,000 in civil penalties and $50,000 for costs. Crucially, Split Rock has agreed to refund resort fees charged as usage fees when facilities were not used by timeshare owners.
